Terms and Conditions – Nesotouch Pty Ltd

Welcome to Nesotouch Pty Ltd. By accessing our website or placing an order, you agree to be bound by these Terms and Conditions.


1. General

· Company: Nesotouch Pty Ltd (Registration number [if any]), registered in South Africa.

· Products: We import goods (including machinery, equipment, and other items) from suppliers in China and sell them to customers in South Africa.

· Applicable law: These terms are governed by the laws of the Republic of South Africa, including the Consumer Protection Act 68 of 2008 (CPA).


2. Orders and Acceptance

· All orders placed through our website are subject to acceptance by us.

· We reserve the right to refuse or cancel any order for reasons including but not limited to: product unavailability, pricing errors, suspected fraud, or violation of these terms.

· An order is confirmed when we send you an order confirmation email.


3. Pricing and Payment

· All prices are in South African Rand (ZAR) and include VAT where applicable.

· We reserve the right to change prices at any time without notice, but such changes will not affect confirmed orders.

· Payment must be made in full via the payment methods offered on our website (credit/debit card, instant EFT, etc.). We do not store full card details.

· By providing payment information, you confirm you are authorised to use that payment method.


4. Import, Customs, and Delivery

· Import sourcing: Products are sourced from China. Delivery times are estimates and may vary due to customs clearance, shipping delays, or other factors outside our control.

· Risk of loss: Once the courier has collected the package from us or our Chinese fulfilment partner, risk of loss or damage passes to you. We will assist with delivery tracking and claims where possible.

· Delivery address: You are responsible for providing an accurate and secure delivery address. Additional charges may apply for re-delivery or incorrect addresses.


5. Warranty and Returns (Incorporating Your Policy)

3-Month Limited Warranty

  • Covers factory electrical or motor faults only.


Warranty does NOT cover:

  • Misuse or overheating
  • Burnt elements
  • Power surges
  • Water damage
  • Physical damage/drops
  • Normal wear & tear
  • Unauthorised repairs


7-Day Return/Replacement Policy

If the machine is faulty immediately after purchase, you must report it within 7 days with:

  • Proof of purchase
  • Video of the fault
  • Picture of the machine

All machines are tested before collection/dispatch. No refunds after use. Repairs/replacements are subject to inspection.


6. Limitation of Liability

  • To the maximum extent permitted by South African law, Nesotouch Pty Ltd shall not be liable for:
  •  Any indirect, incidental, or consequential damages (including loss of profits, data, or use) arising from your purchase or use of our products.
  •  Damages caused by misuse, unauthorised repairs, or failure to follow product instructions.
  • Our total liability for any claim related to a product is limited to the amount you paid for that product.


7. Your Responsibilities

  • You must use products only for their intended purpose and follow any safety or operational instructions provided.
  • You must not attempt to resell our products outside South Africa without our prior written consent.


8. Intellectual Property

  • All content on our website (text, images, logos, designs) is owned by Nesotouch Pty Ltd or our licensors. You may not copy, reproduce, or distribute it without permission.


9. Privacy and POPIA

Your personal information is collected and processed in accordance with our Privacy Policy (available on our website). By using our site, you consent to such processing.


10. Governing Law and Disputes

  •  These terms are governed by South African law.
  • Any dispute arising from your purchase or use of the website shall first be attempted to be resolved through good‑faith negotiation. If unresolved, the dispute may be submitted to the National Consumer Commission or a competent South African court (Magistrate’s Court or High Court, depending on the amount).


11. Changes to These Terms

  • We may update these Terms and Conditions from time to time. Changes take effect when posted on this page. Your continued use of the website after changes constitutes acceptance.
