NESOTOUCH TERMS & CONDITIONS

Welcome to the Nesotouch online store. By accessing our website or placing an order, you agree to these Terms & Conditions. If you do not agree, please do not use our website or services.
1. About Us
Nesotouch (Pty) Ltd is an import, sourcing and e-commerce business supplying products through available stock and pre-order services.
2. Acceptance of Orders
- All orders are subject to acceptance and product availability.
- Nesotouch reserves the right to decline or cancel any order due to:
- Pricing errors
- Product unavailability
- Suspected fraud
- Payment verification issues
- Incorrect product information
- Circumstances beyond our reasonable control
- If payment has already been made, any approved refund will be processed in accordance with our Refund Policy.
3. Pricing
- All prices are displayed in South African Rand (ZAR).
- Prices may change without prior notice.
- Promotional pricing is valid only during the advertised promotional period.
- While every effort is made to ensure pricing accuracy, genuine errors may occur. If this happens, we will contact you before processing your order.
4. Payment
- All online orders require 100% payment upfront.
- Orders will only be processed after full payment has been successfully received.
- Payments are securely processed through approved third-party payment providers.
5. Product Availability
Products displayed on our website fall into one of the following categories:
- Available Stock
- Products ready for dispatch.
- Air Pre-Orders
- Estimated delivery: 7–14 days
- Sea Pre-Orders
- Estimated delivery: 4–8 weeks.
Estimated delivery times are provided for guidance and may be affected by customs inspections, supplier delays, shipping schedules, weather, public holidays, or other circumstances beyond our reasonable control.
6. Order Confirmation
- An order confirmation email does not constitute final acceptance of your order.
- Your order is confirmed once payment has been received and the order has been accepted for processing.
7. Customer Responsibilities
- Customers are responsible for ensuring that:
- Delivery information is accurate.
- Contact details are kept up to date.
- Products ordered comply with any restrictions or legal requirements applicable in their destination.
- Someone is available to receive the delivery where required.
- Nesotouch is not responsible for delays or additional costs arising from incorrect information supplied by the customer.
8. Shipping & Delivery
- Delivery times are estimates only.
- Nesotouch will make every reasonable effort to deliver within the stated timeframes but cannot guarantee delivery dates due to circumstances outside our control.
- Customers will receive updates regarding the progress of their orders where applicable.
9. Inspection of Goods
- Customers should inspect their order immediately upon delivery.
- Any shortages, damages or incorrect items must be reported within 48 hours of delivery, together with supporting photographs where applicable.
10. Returns & Refunds
- Returns, cancellations and refunds are governed by our Refund & Cancellation Policy.
- Customers are encouraged to review that policy before placing an order.
11. Warranty
Where a manufacturer's warranty applies, it will be honoured in accordance with the manufacturer's terms.
Unless otherwise stated, warranties do not cover:
- Normal wear and tear
- Misuse
- Negligence
- Improper installation
- Accidental damage
- Unauthorised repairs or modifications
12. Limitation of Liability
To the maximum extent permitted by law, Nesotouch shall not be liable for:
- Indirect or consequential losses
- Loss of profits or business opportunities
- Delays caused by customs authorities, freight carriers, suppliers, or events beyond our reasonable control
- Losses arising from incorrect customer information
- Nothing in these Terms excludes liability where it cannot legally be excluded under applicable law.
13. Intellectual Property
- All website content, including logos, photographs, graphics, text and designs, remains the property of Nesotouch (Pty) Ltd unless otherwise stated.
- No content may be copied, reproduced or distributed without prior written permission.
14. Privacy
Your personal information is handled in accordance with our Privacy Policy and applicable South African data protection laws.
15. Changes to These Terms
- Nesotouch may amend these Terms & Conditions at any time.
- The latest version will always be published on our website.
16. Governing Law
- These Terms & Conditions are governed by the laws of the Republic of South Africa.
- Any disputes shall be subject to the jurisdiction of the South African courts, unless otherwise required by applicable law.
17.Imported Product Disclaimer
- Many of the products sold by Nesotouch (Pty) Ltd are sourced internationally and imported specifically for our customers.
- While we make every reasonable effort to ensure that product descriptions, specifications and images are accurate, the following may occur from time to time:
- Product packaging may differ from images displayed on the website.
- Colours may vary slightly due to lighting, photography or manufacturer updates.
- Manufacturers may make minor design, branding, packaging or specification changes without prior notice.
- Accessories included with a product may vary slightly between production batches while maintaining the product's intended functionality.
- These minor variations do not constitute defects and do not qualify the product for a return, cancellation or refund, provided the product supplied is substantially the same as the product ordered and performs its intended purpose.
- Where a manufacturer makes a significant change that materially affects the product's functionality or specifications, Nesotouch will notify the customer where reasonably possible and provide an appropriate solution in accordance with our Refund & Cancellation Policy and applicable consumer protection laws.
18. Force Majeure
Nesotouch shall not be liable for any failure or delay in performing its obligations where such failure or delay results from events beyond its reasonable control, including but not limited to:
- Natural disasters
- Fire or flood
- War, civil unrest or government action
- Pandemics or public health emergencies
- Strikes or labour disputes
- Port congestion or shipping line disruptions
- Customs inspections or regulatory delays
- Airline or courier disruptions
- Power outages or failures of communication networks
Where such an event occurs, Nesotouch will make reasonable efforts to keep customers informed and resume performance as soon as reasonably possible.
